as it sits right now, the house cannot be rented nor sold until we go back and clean it up. so now we are debating either putting it up for sale, or putting it in escrow.
I hate when people just dump things off on others because they're too lazy to do it themselves. I'm pretty sure that's what happened here. Your family decided they didn't want to deal with fixing up the house they trashed, going through the hassles of selling/renting in this economy, or anything else for that matter and figured they'd pass it off on you. That's not how family should act. I'm angry that they treated you this way. I'd look into if there's any legal action that can be taken due to them destroying the house that legally should have been yours. I'm no lawyer, but this stinks of ill will, vandalism, and other possible legal things you can sue like crazy over. After all, with grandpa dead for a year and grandma in a home that means neither of the owners did it nor did the intended owner (you). Power of attorney does not give license to do vandalism (trash the place) nor does it make your aunt the owner of the house as I understand things. Your aunt and her family had no right to destroy the house like that. I hope you took lots of pictures and made lots of notes for evidence. The court will want as much as possible. There's a good chance you can make them either clean it themselves and/or pay for the damages. Family doesn't treat family like this. I wouldn't go easy on them because they have made it clear how they feel about you. You (and grandpa and grandma by extension) deserve justice. Ranting aside, welcome back! It's good that you made it home safely. Yeah, I get lost on road trips sometimes, too. Last time I was lost in the mountains on the way to St Louis (long story), but I found my way back.

Having been a reluctant part of a family estate dispute myself last year, I can confidentally say that ANYTHING inside or outside the house that is not SPECIFICALLY credited in the will to a specific person is OFF LIMITS to them- in other words, if the will doesn't say that it's theirs- ist verboten. So if you were left the house/house contents and you can prove that the other family members ransacked the house you can sue them for everything you can prove was in there. At the very least I would recommend making a police report just to make sure you have proof of what happened in case you need it at a later date (ya never know...). Also I'm very sorry that your relatives are treating you this way- some people have no respect for others.

well she had the power of attorney, so she could legally do anything she wanted up till the point my grandmother passed away. Ill just have to work it out with her to get some of the rent money back,m as that was to used to pay the attorney. So if she says no, ill just sic em on her id rather not have to do anything like that, but I cant just coughup that kinda cash. The economy down there seems to be booming right now due to alot of government training centers and the oil and gas industry, so I hope to be able to sell the whole ball of wax once im done cleaning it.

unfortunately power of attorney gives her the right to do anything she sees fit with anything your grandmother owned. A sad fact. There really isn't much recourse at this point, she could just say she had to sell all those other items to help pay for the costs of being in a home. I'd let sleeping dogs lie, sell the house and be done with it. Wash your hands of a bad situation. Glad that your back and doing well. Isn't Texas so bloody boring to drive through? Whenever I drive to Arizona I go through as little of Texas as I possibly can.

no kidding, but after she passed away, everything that was left reverted back to the original will.

Well I feel bad now. I had been trying to contact you and had been updating my ticket (not in an obnoxious manner, mind you) and had no idea there was a forum where I could find out what had happened. A part of me was concerned the site was just abandoned, but after reading through your posts, I understand now.
As you work through your backlog of messages, please take it with a grain of salt and remember that there are some oblivious people like me out there. ^^;;;
I hope everything works out for you in this unfortunate state of affairs.

Bear,
So sorry to hear of your loss...and of your hasle. I too have had a significant loss and subsequent hassle. My mother and grandmother passed within 6 weeks of each other more than a year ago. One of my brothers (the ex-con) was living in the house because, well, he was an ex-con and had no place else to go. Long story short, he refused to move out and cleared out all the valuables...old silver coins from my grandfather, jewelry (including very old ones) were missing stones up to 3 karots, necklaces, medalions...anything of value was gone. His excuse..."I don't know what you're talking about. Grandma started throwing stuff away with her alzhiemers." Even though grandma had been in a nursing home since 2008. ;-(
Finally he has a job in another city and is moving out. So, now we can sell the house. Which is paid for and is a custom home on over 1 acre in a prime real estate area. Now I get to go clean up and fix the house after he has trashed it. Thankfully I went there a few months ago and claimed things that have sentimental value to me. Those mean so much more than money.
Good luck with your situation.
Eq

It is still a pain, but also a gift I was given, so I shall treat it with respect and gladness.
I will have to make one last trip down there in hte next few weeks to finish cleaning it out and getting it ready for sale. was kinda fun going through alot of the stuff when I was thee, seeing what all was hiden and stashed away. I just want to get it done so there can be life in the home again, the laughter of small children.
It hopefully shouldnt take me more than a week there to get everything done and find a way to haul back what I want, and to finish all the paperwork for the sale.

Sorry to hear about your grandparents, I went thru the same thing with my mother passing away in 2007. I had to fight with her husband for my half of the estate, it took over a year with a good lawyer, till he finally gave in. I basically was just hard-headed I told him, if I don,t get my half, then the lawyer is going to eat up the entire estate, so after a year he finally cried "UNKLE" and gave in. you have to weigh the pro's and con's of what your getting into bear. is the house and land worth the trouble, will you get back enough to cover your expenses. and the other poster is right, with "Power of attorney" your aunt could have sold everything. seems like your only option now is, to do what you said your gonna do, but is it worth it. and will you have legal title to the house, make sure before you go doing all the work and cleaning it up, make sure your aunt did not change anything else, when she had power of attorney, as in a new will or something, check out on http://www.zillow.com and see if the house is worth even bothering with, type in the houses address and see what it's worth on the market. anyway's Good Luck, hope all that works out for you. Im still out here, I just pop in every now and then to read your posts, it's interesting to see how your life is coming along. The life and times of Brownbear the homesteading dildo making bear. Think hollywood's ready to make a movie about you yet ) take care ("") HUGS ("")

Yea, this has been a learning experiance to be sure. Some good and some bad, but it has to be done.
I have already checked with the city, and the house is still in thier name, so I just have to transfered to my name, so I can go ahead and sell it.
I also have to do the rest of the cleaning myself on it, as noone else would touch it. My aunt tried to hire a company to do it, but they took a look and told her 25k minimum to do it.
Just a headsaup to folks here, I will be headed back out this coming friday and will be gone for about 2 weeks. During this time the shop will be closed. I will pop on here as I can find places to get a connection so I can see whats going on, and do what I can to help, but all order and customer information will stay here at home for safety.
